- Do I need to re do the C-216C and resubmit it to the RCMP for a date stamp and endorsement?
- Do I have to request again the document from the RCMP showing my prior convictions?
- Do I have to reappear for the interview with the US border office to complete the application I-192?
- Will processing of the application be faster the second time?
- Can I expect, based on my current waiver that the next one will be good for 5 years?

I come from a similar situation which is of course frustrating. I had a conditional discharge in Canada where my convictions were completely erased from my record. Unfortunately I was stupid enough to try to cross the boarder before that took place. Now I do not have any record in Canada but it seems that because I tries to enter the US prior to the conditional discharge I now need to apply for a I-192 US waiver. US Immigration tells me that they do not care about Canadian law. I have applied several times for US Waivers where every time I have to go through the same process. Fingerprints taken, mailed to RCMP, receive record from RCMP, go to US immigration, apply again $300+ dollars US and both times it only lasts a year. I am in the process of applying the third time now where I really hope they give me a 5 year one. All in all, it is the same exact process every year that seems to take upwards of six months so you have to start half way through your current waiver. If you have any suggestions for me that would be helpful but all I can tell you is that it doesn't get any easier..... and I don't even have a criminal record! You think a lawyer could help me get out of this. Going on my third waiver now. To top it off, my girlfriend is American and lives there. Do you know if having a US waiver will ruin my chances at a K1 Visa if we were to be married? Hope I helped and hope someone can help me.

A L1 is possible with a waiver, and you can also relocate to the US, as long as you have a valid waiver. I have been living in the US under L1 visa for almost 3 years now. The !-94 they gave me is valid until the expiration of the visa, or of the waiver, whichever comes first.
ReplyDeleteSimilarly, I had an I-94 as an F-1 student that was good for "duration of study" provided I didnt leave the country (unless to Can or Mex for less than 30 days). I have the indefinite waiver they used to give out with BCCs.
ReplyDeleteI was told by a woman who's applied several times that the one year waiver is the norm but if you include in your letter a request to be considered for a longer period waiver, you're more likely to get the period extended to 2 or 5 years. It's anecdotal but doesn't hurt to ask.
ReplyDeleteI think the reapplication for the waiver would be quite faster than what you had experienced during your first application. That is because they already have all the information about you, and all they have to do is to update and renew it. Anyway, for some of your questions, I think you should have an immigration attorney help you answer those. An attorney can give a better explanation about those things.
