I asked a question about NEXUS (frequent traveller program) at the CBP Info Center and received a response in about 3 days.
As a Canadian with a criminal record, if I have an I-194 waiver, can I apply for and be granted a NEXUS card?
Thank you for contacting the CBP Info Center.If you have a waiver, it is unlikely that you will be eligible for NEXUS membership based off of the general eligibility requirements and checks (ie: criminal background check).

ReplyDeleteI can tell you that the information that you have received is not fully accurate. I successfully received a Nexus card with a 22 year old conviction for a petty offense. the offense was never expunged and happened in the US (I live in Canada). To be considered for a Nexus the misdemeanor needs to be 10+ years ago. You need to supply copies of your conviction and it is recommended that you apply via the paper form and mail it in. It will take time. From there you may be conditionally approved and will be set up for an interview. At the interview you will be required to bring all supporting information related to your conviction. If you want more info just reply
So I have a sealed misdemeanor conviction from 2004. In addition, I had it sealed in the FBI database. Do I need to show anything for Nexus or simply disclose it?

ReplyDeleteArticle referencing the ability to obtain Nexus even with misdemeanor. This article was what guided me to apply. I actually reached out toe the lawyer that is referenced and got some guidance.
Canadian Pardons Services Dont Know What they are talking about. I called them in regards my circumstances asking for advice, Then 2 weeks later called back and they offered me completely different advice. They say that a record destruction including fingerprints destruction will not show on usa systems, this is untrue, Even a sealed record is available to border agents. The process for sealing a record if you were charged and not convicted is so simple anyone can do it. Why pay 100s to these guys for writing a letter. When I first called them they would not let me finish my questions without registering a credit card with them.
