Record Suspension, YouTube edition

Everyone who reads this blog already knows that you don't need a lawyer to get an I-194 US waiver. The application and interview – although bureaucratic – is something you can do yourself. Well, it's the same with a Record Suspension (formally called a Pardon) and the Parole Board of Canada (PBC) is doing their best to teach the public this important fact.

Last February the PBC created a YouTube channel that already has a surprisingly good list of helpful content. While not recognized by the US, it's still quite obvious that getting a Record Suspension is a good idea. If you've started your application and need some help, PBC has created this short 4 minute video "Tips for completing a Record Suspension Application".


The main point PBC is trying to share is that you don't need a pardon services company to make an application for a Record Suspension. To emphasize this point, PBC has even created a complete educational video series on "How to Apply for a Record Suspension". 17 segments long containing 7 chapters it should certainly be enough to help even the most unacademic of us Canadian criminal record bearers.   1. Under the Conservative Government, our Pardon system was changed under the guise of "crime and punishment".
    Canada had the ONLY Pardon system of its kind in the world, and it was unique.
    It was FAIR.
    It simply allowed people with older criminal records to find employment.
    The Conservatives used it as a political tool. They made pardons more expensive and "tougher". They appointed their friends and donors to the Parole Board with instructions to "re-try past offenders" because they believe the judges were too "lenient".
    The implementation of this policy did nothing to prevent crime.
    It did succeed in stopping thousands of pardons. In preventing thousands of people from getting employment. From those people better taking care of thousands of children.
    It kept scores of single moms on social assistance. It cost taxpayers in Ontario alone hundreds of thousands of dollars by effectively trapping people on social assistance and preventing them from paying taxes.
    It de-motivated, demoralized and discouraged many people in vulnerable situations already. It pushed people further to the margins of society.
    Instead of giving people an opportunity to legitimately go the "right way", it cut off that avenue and literally encouraged them to return to crime.

    It showed the Conservatives cared more about punishment than prevention, retribution more than compassion.
    That may be the Conservative way, but I do not believe it is the Canadian way.
    We want the Trudeau Government to BRING BACK FAIRNESS.

Do you have an I-194 waiver?

Thanks to those who participated in my recent poll "Do you have an I-194 waiver?". It turns out that of those who participated over half have applied or intend to for the I-194 waiver (Advance Permission to Enter as a Non-Immigrant). It is also interesting to note that the amount that have 1 year or 5 year waivers are very close (3 to 4). I had read somewhere that the waivers were granted as 1 year or 5 based on the degree or seriousness of the past offenses. If this is true, then wouldn't a person expect that if he/she were granted a 5 year waiver, he/she should always expect the 5 year waiver? Check Your Waiver Application Status

I've never tried, but apparently there is an email address to check your waiver application status. CHECKING THE STATUS OF YOUR WAIVER REQUEST: Please allow at least 120 days from the date of submission of your I-192 before making an inquiry about the status of your application. As stated earlier, a full review of your circumstances can take up to a year, and requests for status updates may add to that timeline. However, if for some reason you are concerned about the status of your request, and you filed at a CBP Preclearance location or at a land border port of entry after August 26, 2007 you may ask for an update by emailing inquiry.waiver.aro@dhs.gov . In the email, be sure to provide your full name, DOB and your A number. If you filed at a land border port of entry prior to August 26, 2007, please contact them directly. I-194 waiver renewal - another 5 years!

Great news! Today in the mailbox, just 3 months and 2 weeks after submitting my I-192 application with a Saturday interview at the Ottawa pre-clearance facility, I received my renewal (my second 5 year I-194 waiver) . This second 5 year waiver once again allows me to travel to the US for business and pleasure (B1/B2) for a maximum period of stay as determined by the admitting officer (the CBP officer on entry) .
